{"id":26895,"date":"2023-10-16T14:28:28","date_gmt":"2023-10-16T14:28:28","guid":{"rendered":"https:\/\/saj.pachecostudios.com?p=26895"},"modified":"2023-10-16T14:28:30","modified_gmt":"2023-10-16T14:28:30","slug":"aviation-groups-question-regulatory-overhaul-for-flights-vital-to-underserved-communities-2","status":"publish","type":"post","link":"https:\/\/stateaviationjournal.com\/index.php\/national-news\/aviation-groups-question-regulatory-overhaul-for-flights-vital-to-underserved-communities-2\/%20","title":{"rendered":"Aviation Groups Question Regulatory Overhaul for Flights Vital to Underserved Communities"},"content":{"rendered":"\n<p>Seven leading aviation groups <a href=\"https:\/\/www.nata.aero\/assets\/Site_18\/files\/FAA\/NOIGroupResponse101323.pdf.pdf\">joined last week to comment<\/a> on a Federal Aviation Administration (FAA) notice proposing sweeping revisions to regulations that impact part 135 charter operators, including on-demand air carriers operating Department of Transportation (DOT)-authorized public charter operations, which provide vital air service to small communities.<\/p>\n\n\n\n<p>\u201cChanges to regulatory definitions could have unintended\nnegative consequences throughout the entire part 135 community\u2014an established\nindustry segment providing safe and secure transportation options that meet the\ndiverse needs of thousands of communities across the nation,\u201d wrote the\ncoalition.<\/p>\n\n\n\n<p>In August, the <a href=\"https:\/\/www.nata.aero\/pressrelease\/aviation-groups-question-regulatory-overhaul-for-flights-vital-to-underserved-communities\">FAA issued<\/a> a Notice of Intent (NOI) suggesting potential revisions to the regulatory definitions of \u201con-demand operation,\u201d \u201csupplemental operation\u201d and \u201cscheduled operation\u201d under 14 CFR Part 110. FAA regulations govern the operations of air carriers, while DOT part 380 regulations address economic authority for those offering public charters. Current regulations allow a part 380 operator to work with any air carrier, including on-demand carriers operating under Part 135.<\/p>\n\n\n\n<p>\u201cFor more than 45 years, part 135 carriers have operated\naircraft safely and reliably on behalf of public charter operators under DOT\npart 380, unlocking substantial public benefits and providing valuable air\ntransportation to many communities that otherwise would not have commercial air\nservice.\u201d&nbsp; <\/p>\n\n\n\n<p>\u201cChanging regulations could eliminate well-paying jobs at\nall levels of the industry while hurting economic competition, carbon emissions\nreduction, emerging technologies, aviation innovation, and service to small\ncommunities. Any changes to the regulation should be driven not by the economic\ninterest of competitors, but by an identified safety need.\u201d<\/p>\n\n\n\n<p>In putting forward the notice, FAA officials presented a\ndata set pointing to the growth in flights conducted under Part 380 over the\npast decade as the basis for the agency\u2019s proposed regulatory review. However,\nthe operational increase has come with no major incidents or accidents under\nthe current regulatory framework, which makes the motive for the FAA\u2019s action\nunclear.<\/p>\n\n\n\n<p>While the number of part 380 operations has increased over\nthe past decade in response to declines in commercial airline service to\nsmaller communities, those flights comprise a very small part of the more than\n52 million total operations within the national airspace system in 2022.<\/p>\n\n\n\n<p>Comments to the FAA notice were submitted and co-signed by\nthe Airline Passenger Experience Association (APEX), General Aviation\nManufacturers Association (GAMA), Helicopter Association International (HAI),\nInternational Flight Services Association (IFSA), National Air Transportation\nAssociation (NATA), National Association of State Aviation Officials (NASAO),\nand National Business Aviation Association (NBAA).&nbsp; <\/p>\n\n\n\n<p>Today\u2019s comments follow concerns expressed by several associations earlier this year about inaccurate characterizations of part 135 operators conducting part 380 public charter flights in response to one carrier\u2019s economic application to the agency to launch such an operation.
