{"id":24848,"date":"2023-02-20T17:22:03","date_gmt":"2023-02-20T17:22:03","guid":{"rendered":"https:\/\/saj.pachecostudios.com?p=24848"},"modified":"2023-02-20T17:30:51","modified_gmt":"2023-02-20T17:30:51","slug":"auvsi-announces-publication-of-legal-white-paper-announced-to-help-states-prepare-for-drones","status":"publish","type":"post","link":"https:\/\/stateaviationjournal.com\/index.php\/unmanned-systems\/auvsi-announces-publication-of-legal-white-paper-announced-to-help-states-prepare-for-drones\/%20","title":{"rendered":"AUVSI Announces Publication of Legal White Paper Announced to Help States Prepare for Drones"},"content":{"rendered":"\n<p>The Association for Uncrewed Vehicle Systems International (AUVSI) recently announced the publication of a <a href=\"http:\/\/auvsilink.org\/DronePrepared\/As%20the%20Drone%20Flies.pdf\">legal white paper<\/a> analyzing airspace law and offering a plan for how states and localities can consider uncrewed aircraft system (UAS, or drone) laws that enable the rapidly growing industry without infringing upon existing authorities.<\/p>\n\n\n\n<p>\u201cAs the Drone Flies: How to Think About Property Ownership,\nFederal Preemption, and Airspace Control in the Era of Remotely Piloted\nAircraft\u201d is authored by Sara Baxenberg and Josh Turner, experienced drone and\npreemption attorneys at Wiley Rein who serve as outside counsel to AUVSI. They\naddress two key legal issues: first, the rights of individual property owners\nin the surface of their property as compared to the airspace above, and second,\nthe authority of states and localities given federal preemption in the fields\nof air navigation and aviation safety.<\/p>\n\n\n\n<p>&#8220;While the advent of drones may appear to pose an\ninflection point for a variety of traditional legal concepts, these supposed\nconflicts are, in actuality, easily resolved,\u201d said Sara Baxenberg, Partner at\nWiley Rein LLP. \u201cStates can protect rights, interests, and assets in a way that\nensures that the rules are clear for all stakeholders and all interests are\nadequately safeguarded.\u201d<\/p>\n\n\n\n<p>The paper follows the launch of AUVSI\u2019s multi-state Drone\nPrepared initiative to help lawmakers ensure that their state or locality is\nready for the benefits the future of uncrewed and autonomous flight will bring\nto their communities.
