Chao today announced the publication of the Federal Aviation Administration\u2019s (FAA) Streamlined Launch and Reentry Licensing Requirements <a href=\"https:\/\/www.faa.gov\/space\/streamlined_licensing_process\/media\/SLR2_Final_Rule_450.pdf\">Final Rule<\/a> (PDF) for commercial space transportation <a href=\"https:\/\/www.faa.gov\/space\/streamlined_licensing_process\/\">launches and reentries<\/a>.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"\/wp-content\/uploads\/FAA-Commercial-Space.jpg\" alt=\"\" class=\"wp-image-16659\" width=\"343\" height=\"212\" srcset=\"https:\/\/stateaviationjournal.com\/wp-content\/uploads\/FAA-Commercial-Space.jpg 424w, https:\/\/stateaviationjournal.com\/wp-content\/uploads\/FAA-Commercial-Space-300x185.jpg 300w\" sizes=\"auto, (max-width: 343px) 100vw, 343px\" \/><\/figure><\/div>\n\n\n\n<p>\u201cThis historic, comprehensive update to commercial space\nlaunch and reentry licensing requirements facilitates greater growth in this\nindustry and helps America to maintain our #1 position in the world,\u201d said U.S.\nTransportation Secretary Elaine L. Chao.<\/p>\n\n\n\n<p>This rule modernizes the way FAA regulates and licenses\ncommercial space operations and allows the burgeoning aerospace industry to\ncontinue to innovate and grow, while maintaining public safety. <\/p>\n\n\n\n<p>Deputy Assistant to the President and Executive Secretary of\nthe National Space Council Dr. Scott Pace said, \u201cIn meeting the President\u2019s\nmandate in Space Policy Directive-2 to streamline regulations on commercial\nspaceflight, the Department of Transportation is strengthening the United\nStates\u2019 continued leadership in space commerce. I commend Secretary Chao, the\nDepartment, and the Office of Commercial Space Transportation for updating\nlaunch regulations and licensing to ensure the United States remains the flag\nof choice for the growing commercial space sector.\u201d<\/p>\n\n\n\n<p>The new rule consolidates four regulatory parts and applies\na single set of licensing and safety regulations for all types of vehicle\noperations. It also provides flexibility for operators to meet safety\nrequirements. The rule improves efficiency by encouraging launch and reentry\noperators to suggest and implement design and operational solutions to meet the\nregulatory standards.<\/p>\n\n\n\n<p>\u201cThis rule paves the way for an industry that is moving at\nlightning speed,\u201d said FAA Administrator Steve Dickson. \u201cWe are simplifying the\nlicensing process and enabling industry to move forward in a safe manner.\u201d <\/p>\n\n\n\n<p>The final rule\u2019s improved application processes allow:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A single operator\u2019s license that can be used to\nsupport multiple launches or reentries from potentially multiple launch site\nlocations.<\/li><li>Early review when applicants submit portions of\ntheir license application incrementally.<\/li><li>Applicants to negotiate mutually agreeable\nreduced time frames for submittals and application review periods.<\/li><li>Applicants to apply for a safety element\napproval with a license application, instead of needing to submit a separate\napplication.<\/li><li>Additional flexibility on how to demonstrate\nhigh consequence event protection.<\/li><li>Neighboring operations personnel to stay during\nlaunch or reentry in certain circumstances.<\/li><li>Ground safety oversight to be scoped to better\nfit the safety risks and reduce duplicative requirements when operating at a\nfederal site.<\/li><\/ul>\n\n\n\n<p>This rule will become effective 90 days after publication in\nthe Federal Register. The FAA will initially seek public comment (for a period\nof 30 days) on three Advisory Circulars&nbsp;\n(ACs) on the following topics:&nbsp;\nHigh Consequence Protection (PDF), High Fidelity Flight Safety Analysis\n(PDF), and Computing Systems and Software (PDF). The FAA may issue updated\nversions of these ACs if warranted based on comments received.&nbsp; Each AC will contain a feedback form with\nspecific instructions on how to provide comments to the FAA on that AC.<\/p>\n\n\n\n<p>Twenty-four additional ACs will be published within one year\nor as needed. Legacy licenses can still be used for up to five years after the\nrule\u2019s effective date.<\/p>\n\n\n\n<p>FAA is responsible for ensuring the protection of the public, property, national security and foreign policy interests of the U.S. during commercial launch or reentry activities. The agency also encourages, facilitates, and promotes U.S. commercial space transportation. To date, FAA has <a href=\"https:\/\/www.faa.gov\/data_research\/commercial_space_data\/\">licensed<\/a> or permitted more than 380 launches and reentries.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>U.S. Secretary of Transportation Elaine L.
